State: Gaming tribes underpay millions | Santa Fe, N.M. | KRQE ...

SANTA FE (AP) - State gaming regulators say most of New Mexico's 14 tribes that operate casinos could soon receive notices that they're not complying with agreements for sharing their casino take with the state.

Gaming board chairman David Norvell tells the Santa Fe New Mexican that "most" of the gaming tribes are responsible for what now totals an underpayment of between $13 million and $20 million, although he couldn't specify which ones.

The issue is "free play" aimed at getting gamblers in the door. Norvell says the casinos wrongly incorporate it in a formula used to determine what they owe the state.

Pojoaque Pueblo chief executive Allen Mosley says if you give something to someone for free, why should you have to pay a tax?

In the second quarter of 2011, tribes paid the state about $16 million in revenue sharing.
